Terms of Service and End User License Agreement

I. Introduction

These Terms of Service and End User License Agreement (collectively, the “Agreement”) govern your access to and use of the Fonts AI mobile application (“App”) provided by LYAM APPS FZE (“we”, “us”, or “our”). By downloading, installing, or using Fonts AI, you agree to be bound by this Agreement. If you do not agree to these terms, please do not use the App.

II. Changes to This Agreement

We reserve the right to modify or update this Agreement at any time, in our sole discretion. Any changes will become effective immediately upon posting on our website or within the App, and your continued use of Fonts AI constitutes your acceptance of such changes. It is your responsibility to review this Agreement periodically.

III. Eligibility

By using Fonts AI, you represent and warrant that you are at least 18 years of age, or if you are under 18, that you have obtained the consent of a parent or guardian to use the App. If you are under the age of 13, you are not permitted to download, install, or use the App.

IV. General Terms

Fonts AI is designed to transform text into creative, artistic fonts and symbols for your personal, non-commercial use. The App is provided “as is” and “as available” for your creative expression and enjoyment.

Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and safeguard your information.

VI. End User License Agreement (EULA)

Subject to your compliance with this Agreement, we grant you a limited, non-exclusive, non-transferable, revocable license to download and use Fonts AI for your personal, non-commercial purposes. You agree not to modify, copy, distribute, or create derivative works based on the App, except as expressly permitted by law.

VII. Subscription and Payments

Fonts AI is available via subscription. Access to premium features requires an active subscription, which may automatically renew unless cancelled at least 24 hours before the end of the current subscription period or free trial period. Subscription fees are billed through your device’s payment system. You are responsible for any charges incurred.

You agree not to use Fonts AI in any way that is unlawful or harmful. Prohibited conduct includes, but is not limited to:

IX. Third-Party Services and Content

Fonts AI integrates with third-party services, such as Firebase and AppsFlyer, to enhance functionality and provide analytics. Your use of these services is subject to their respective terms and privacy policies. We are not responsible for the practices of these third parties.

X. Disclaimer of Warranties

The App and its services are provided “as is” and “as available” without any warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee that Fonts AI will be error-free or uninterrupted. Your use of the App is at your own risk.

XI. Limitation of Liability

In no event shall we be liable for any indirect, incidental, consequential, or punitive damages arising from your use of Fonts AI. Our total liability, in any case, shall not exceed the amount you paid (if any) for accessing the App.

XII. Governing Law and Dispute Resolution

This Agreement shall be governed by and interpreted in accordance with the laws of the state of Florida, USA. All disputes, claims, or proceedings arising out of or related to this Agreement—including those relating to its performance or alleged breach—shall be exclusively resolved in the courts of competent jurisdiction in the state of Florida.

We make no representations that Fonts AI is appropriate or available for use outside of the USA. If you choose to access or use the App from a location outside the United States, you are solely responsible for ensuring that your use complies with local laws.

Class Action Waiver: You expressly agree to waive your right to participate in any class action or class-wide proceedings in connection with any dispute or claim arising out of or relating to this Agreement or the App.

In the event of any controversy, allegation, or claim, both you and we agree to send a written notice describing the dispute along with a proposed resolution. For a period of 60 days from receipt of such notice, we will engage in dialogue to attempt to resolve the dispute before pursuing any other legal remedies.

XIII. Termination

We reserve the right to suspend or terminate your access to Fonts AI at our sole discretion if you violate this Agreement or engage in conduct that is harmful to the App or its users. Upon termination, all rights granted to you under this Agreement will immediately cease.

XIV. Severability

If any provision of this Agreement is held to be invalid or unenforceable, that provision shall be enforced to the maximum extent possible and the remaining provisions shall remain in full force and effect.
